Indian e-Tourist Visa

Who can get Indian E Tourist Visa

Eligibility Criteria
  1. Your sole objective of visiting India is recreation,sight seeing,casual visit to meet friends or relatives, short duration medical treatment or casual business visit and you must enter through 16 designated airports(list is given bottom of this page 
  2. Your Passport should have at least six months validity from the date of arrival in India. The passport should have at least two blank pages for stamping by the Immigration Officer.
  3. You should have return ticket or onward journey ticket,with sufficient money to spend during his/her stay in India.
  4. Each individual visitor should have a separate passport.and it is not available to individuals endorsed on Parent’s/Spouse’s Passport
  5. Not available to those who are having Pakistani Passport or Pakistani origin. They must apply for regular Visa at Indian Mission.
  6. Not available to Diplomatic/Official Passport Holders.Means, it is available for Regular/Normal Passport holders
  7. Not available to International Travel Document Holders(Like UN Refugee Card)-You must have a regular passport
Validity of Indian E Tourist Visa
  • e-Ttourist Visa is a single entry visa and it is valid for 30 days from the date of issue
How Many Days I can stay on Indian E Tourist Visa
  • You can stay up to 30 days from the date of arrival but must arrive before the expiry date of visa.
  • Also note,e-Tourist Visa  is allowed for a maximum of two visits in a calendar year.
  • e-Tourist Visa is a single entry , non-extendable , non-convertible & not valid for visiting Protected/Restricted and Cantonment Areas.
Time Taken to process Indian E Tourist Visa
  • Minimum 4 working days
  • You may apply online minimum 4 days in advance of the date of arrival with a window of 30 days.
  • Example : If you are applying on 1st September then applicant can select arrival date from 5th September to 4th October
Fee for Indian E Tourist Visa
  • US$ 60/- per passenger excluding interchange charge for credit/debit cards.
  • The fee must be paid at least 4 days before the expected date of travel filled by you otherwise application will not be processed
  • eTV fee once submitted is non-refundable as the fee is for processing of the application and is not dependent on either Grant or Rejection of VISA.
Documents to required to apply for Indian e-Tourist Visa
  1. Scanned First Page of Passport containing personal details like name,date of birth, nationality , expiry date etc. to be uploaded by the applicant.
    • Passport Scan Format -PDF Size : Minimum 10 KB ,Maximum 300 KB
  2. Recent front facing digital photograph with white background and
    • The digital photograph to be uploaded along with the Visa application should meet the following requirements:
    • Format – JPEG Size- Minimum 10 KB Maximum 1 MB
    • The height and width of the Photo must be equal.
    • Photo should present Full face, front view, eyes open.
    • Center head within frame and present full head from top of hair to bottom of chin.
    • Background should be white and plain
    • Photo should be without borders.
The application is liable to be rejected if the uploaded document and photograph are not clear / as per specification.
Documents required at the Time of Travel to India
  1. Passport should have at least six months validity from the date of arrival in India. The passport should have at least two blank pages for stamping by the Immigration Officer.
  2. You  must have return ticket or onward journey ticket,with sufficient money to spend during his/her stay in India.
  3. Nationals of Yellow Fever affected countries must carry YELLOW FEVER VACCINATION CARD at the time of arrival in India, otherwise they may be quarantined for 6 days upon arrival in India. Please visit  Ministry Of Health & Family Welfare latest guidelines regarding yellow fever countries here.
  4. eTV is valid for entry through 16 designated Airports i.e.  Ahmedabad, Amritsar, Bengaluru, Chennai, Cochin, Delhi, Gaya, Goa, Hyderabad, Jaipur, Kolkata, Lucknow, Mumbai, Tiruchirapalli, Trivandrum & Varanasi. However, the foreigner can take exit from any of the authorized Immigration Check Posts (ICPs) in India
Repeat Visit

Indian Tourist Visa Information

Who is eligible to get a Indian Tourist Visa
Tourist Visa is granted for visiting India for recreation, sightseeing, casual visit to meet friends and relatives etc. No other activity is permissible on a Tourist Visa.
Note: If a person holding ‘Tourist’ visa is found to be involved in Business activities or found working, action may be taken for visa violation.

What is the Validity of an Indian Tourist Visa?
Generally tourist visa is given for 6 months; it can be more or less and it specifically depends on the country of residence.
Tourist visa up to 5 years may be granted if the foreigner is connected with the tourism trade.

What documents required for Indian Tourist visa
The applicant is required to produce/submit documents in proof of his financial standing, travel, accommodation etc.

Instructions for Foreigners possessing Tourist Visa.

  1. A Tourist Visa can be granted to a foreigner who does not have a residence or occupation in India and whose sole objective of visiting India is recreation, site seeing, causal visit to meet friends/relatives in India.
  2. Tourist visa is non extendable and non convertible.
  3. There shall be a gap of at least two months between two visits to India on a Tourist Visa.
  4. If a foreign national is required to visit the country again within a period of two months of his last departure such foreign nationals shall obtained special permission from the mission/port concerned.

Registration:
Registration with the nearest FRRO/FROs is required only if the foreigner holding tourist visa has entered India for the second time within 60 days of the last departure.
Such Residential Permit/Registration Certificate issued to the foreigner whould be valid only for period of 180 days or 90 days as the case may be. The 180 days would be calculated from the 1st date of entry into the country within 60 days.
Once such a foreigner exits the country after availing the facility (within the visa validity period or the stay stiuplation period of 180/90 days as the case may be) there shall be a gap of atleast two month from the date of final exit before he/she can come again to India.

Penalty for late Registration
No fee is requried to be paid for registraiton, but a penalty in Indian Currency equivalent to US$ 30/- (Rs. 1395/-) in case of late registration is charged.

Requirements at the time of Registration
Every foreigner at the time of Registration, shall furnish, such information in registration report, as may be in his possession for the purpose of atisfying the Registration Officer and shall, on being required, shall sign the registration report in the presence of the said officer and shall thereupon be entitled to receive from the said officer a certificate of registration in Part-III of Form-A.
The following documents are required to be submitted at the time of registration.
  • 4 recent passport size photographs;
  • Photocopy of arrival stamp, photo page and valid Indian Visa page of the passport;
  • Proof of residential address in India or copy of C-Form from the Hotel

Over View About Indian Visa

Citizens of all countries, except Nepal and Bhutan and Maldives(for a stay up to 90 days), require a national passport or travel documents and a visa granted by Indian Missions abroad for entering India. Citizens of Few countries can avail visa on arrival for a stay up to 30 days maximum. All other visitors should apply for visa at the Indian Diplomatic Missions in their country of residence or nearest Mission en route.

Nepalese or Bhutanese citizens need no passport or visa but should possess documents for their identification when proceeding from their countries. However, if they are entering India from a place other than their own country then possession of passport is a must. Further, if they arriving from mainland China, visa is required (note: does not incl. Hong Kong or Macao)

Also visa is exempted for those holding a PIO (Person of Indian Origin) card.
Apart from getting visa foreigners are required to obtain Protected/restricted area permit, if they are planning to visit any of the protected/restricted areas.

Important Note:
Ø Nationals of Maldives require a visa to India, other than tourism purpose (stay up to 90 days).
Ø Citizens of Nepal require a visa when entering India from China.
Ø If citizens of Nepal and Bhutan enter Indian without passport or visa from any country other than the Nepal or Bhutan, entry in to Indian will be refused

INDIAN EMPLOYMENT VISA


What is an Employment Visa? 
 An Employment Visa is granted to foreigners desiring to come to India for the purpose  of employment, subject to fulfillment of the following conditions:

(i) The applicant is a highly skilled and/or qualified professional, who is being engaged or appointed by a company/ organization/ industry/ undertaking in India on contract or employment basis.
(ii) Employment Visa shall not  be granted for jobs for which qualified Indians are available. Employment
Visa shall also not be granted for routine, ordinary or secretarial/clerical jobs.
(iii) The foreign national seeks to visit India for employment in a company/ firm/organization
registered in India or for employment in a foreign company/ firm/organization engaged for execution of
some project in India.
(iv) The foreign national being sponsored for an Employment Visa in any sector should draw a salary
in excess of US$ 25,000 per annum.  However, this condition of annual floor  limit on income will not
apply to:
 (a) Ethnic cooks,
 (b) Language teachers (other than English language teachers) / translators and
 (c) Staff working for the concerned Embassy/High Commission in India.
The application for Employment Visa may be rejected by the Indian Mission/Post concerned in case the minimum annual income benchmark of US$ 25,000 is not met, except in the case of the three categories mentioned above. There will be no need to refer such cases for consideration of the Ministry of Labour &
Employment for clearance.  The guidelines issued by the Ministry of Labour & Employment vide their OM
no.DGET-M-26025/4/2009-MP(G) dated 8thSeptember 2009 and the amendment dated 22nd December, 2009 will no longer be applicable in view of these stipulations.
(v) The foreign national must comply with all legal requirements like payment of tax liabilities etc.
(vi) The Employment Visa must be issued from the country of origin or from the country of domicile of the foreigner provided the period of permanent residence of the applicant in that particular country is more than 2 years.
(vii) The documents/ papers pertaining to the proposed employment, like the registration of the company
under the Companies Act, proof of registration of the firm in the State Industries Department or the Export
Promotion Council concerned, or any recognised promotional body in the field of industry and trade etc
will be thoroughly checked to decide the category of visa that may be issued to the foreigner. The name of the sponsoring employer / organization shall be clearly stipulated in the visa sticker.

What are the other categories of foreign nationals who are eligible for Employment visa? 


Subject to the fulfillment of the conditions enumerated in Question B5 above, the following categories of foreign nationals will also be eligible for Employment visa:-
(i) Foreign nationals coming to  India as consultant on contract for whom the Indian company pays a fixed
remuneration (this may not  be  in  the  form  of  a monthly salary).

(ii) Foreign artists engaged to conduct regular performances for the duration of the employment
contract given by Hotels, Clubs, other organizations.
(iii) Foreign nationals who are coming to India to take up employment as coaches of national /state level teams
or reputed sports clubs.
(iv) Foreign sportsmen who are given contract for a specified period by the Indian Clubs/organizations.
(v) Self-employed foreign nationals coming to India for providing engineering, medical, accounting, legal or
such other highly skilled services in their capacity as independent consultants provided the provision of
such services by foreign nationals is permitted under law.
(vi) Foreign language teachers/interpreters.
(vii) Foreign specialist Chefs.
(viii) Foreign engineers/technicians coming to India for installation and commissioning of
equipment/machines/tools in terms of the contract for supply of such equipment/machines/tools.
(ix) Foreign nationals deputed  for providing technical support/services, transfer  of know-how/services for
which the Indian company  pays fees/royalty to the foreign company.

What is the duration of an Employment Visa? 


Validity of an Employment visa will be as follows:-
 
(i) A foreign technician/expert coming to India in pursuance of a bilateral agreement between the Government of India and the foreign government or in pursuance of a collaboration agreement that has been approved by the  Government of India, can be granted an Employment visa for the duration of the agreement,  or for a period of five years, whichever is less, with multiple entry facilities.
(ii) In the case of highly skilled foreign personnel being employed in the IT software and IT enabled sectors, the Missions/Posts can grant Employment visa with validity up to 3 years or the term of assignment, whichever is less, with multiple entry facility.
(iii) A foreigner coming to India for employment not covered in (i) or (ii) above can be granted Employment visa with a validity up to two years or the term of assignment, whichever is less, with multiple entry facility.
(iv) In the case of Employment Visa issued for a period of 180 days or less, registration is not required with
FRRO/FRO.  The Missions/Posts may issue multiple entry Employment Visa for a period of 180 days or less.
(v) However, if the Employment visa is valid for a period of more than 180  days, it should carry an endorsement to the effect that the E-visa holder must register with the FRRO/FRO concerned within 14 days of arrival.
(vi) On registration, the  FRRO/FRO concerned may issue Residential Permit for the validity of the visa
period.  However, if there is any change in the residential address, the  foreign national concerned shall immediately report the change of address, in writing, to the FRRO/FRO concerned.
(vii) The Employment visa may be extended by the State Governments / UTs / FRROs / FROs beyond
the initial visa validity period, up to a total period of 5 years from the date  of issue of the initial Employment Visa, on an year to year basis, subject to good conduct, production of necessary documents in support of continued employment, filing of Income Tax  returns and no adverse security inputs about the foreigner.  The period of extension shall not exceed five years from the date of issue of the initial Employment visa.

What documents are required to be submitted alongwith application for Employment Visa?


(i) The foreign national  must have a valid travel document and a re-entry  permit, if required under
the law of the country concerned.
(ii) The foreign national must  submit proof of his/her employment of contract  or engagement by the
company / organization, etc. in India.
(iii) The foreign national must submit documentary proof of his educational qualifications and
professional expertise.
(iv) The foreign national  must submit documents/ papers pertaining to the proposed employment, like
the registration of the company under the Companies Act, proof of registration of the firm in the State Industries Department or the Export Promotion Council concerned, or any recognised promotional body in the field of industry and trade etc.



Which category of Visa will be granted to family members of foreign nationals coming to India on Employment? 

Family members/ dependents of a foreigner who is granted  `E’ visa shall be granted `X' visa subject to usual
security checks provided the family members are otherwise eligible for grant of such a Visa.   Its validity shall be coterminus with the validity of the visa of the principal visa holder [or for such shorter period as may be considered necessary by the Indian Mission]

Whether Employment visa can be converted to any other type of visa within the country? 

Employment Visa cannot be converted to any other kind of visa during the stay of the  foreigner in India except in the following circumstances and with the prior approval of the Ministry of Home Affairs:
a) Employment visa can be converted to ‘X’ (Entry) Visa if a foreigner who  has come to India on Employment visa marries an Indian national during the validity of his/her visa and does not intend to
continue on Employment Visa. Such conversion would be considered subject to fulfillment of following conditions:
(i)     submission of a copy of registered Marriage Certificate , and
  (ii)     report from the FRRO/FRO concerned about their marital  status which  will inter-alia include his/her antecedents, confirmation about their living together and security clearance.
b) Employment visa in case of Persons of Indian Origin, who were otherwise entitled for ‘X’ (Entry)
Visa but have entered into India on Employment visa, can also be converted to ‘X’ Visa.
c) Employment visa of the foreigners who fall ill after their entry into India rendering them unfit to travel
and require specialized medical treatment can be converted to Medical visa if they are eligible for grant of Medical Visa and medical certificate is obtained from government/government-recognized hospitals. In such a case, ‘X’ visa of family members/ attendant accompanying the foreigner (whose ‘Employment’ visa is converted into 14Medical Visa) can also be converted into Medical Attendant [Med X] visa co-terminus with the Medical visa of the foreigner.
Note: On conversion of Employment visa into ‘X’ visa / Medical visa/ ‘Med X’ visa, the following endorsement shall be  made on the Passport / Residential Permit  - “Employment/Business not permitted”.

INDIAN BUSINESS VISA

 Business Visa designated as ‘B’ Visa


What are the conditions to be fulfilled for grant of a  Business visa?

Ans.:  The conditions to be fulfilled for grant of a Business visa are as follows:-
  • The foreign national must have a valid travel document and a re-entry permit, if required under the law of the country of nationality of the applicant.
  • The foreign national should  be a person of assured financial standing.  The foreigner must submit proof of his/her financial standing and documentation in support of intended business visit to India.  Proof of his financial standing and expertise in the field of intended business will be checked thoroughly by the Indian Missions while granting the visa.
  • The foreign national should not be visiting India for the business of money lending or for running a petty business or petty trade or  for full time employment in India, etc.
  • The foreign national shall comply with all other requirements like payment of tax liabilities etc.
  • The Business Visa must be issued from the country of origin or from the country of habitual domicile of the foreigner provided the period of residence of that foreigner in that particular country is more than 2 years.  If the period of  permanent residence of the applicant in the particular country is less than two years, the Mission / Post concerned will issue Business visa only after personal interview, review of documentation and prior clearance from the Mission where the applicant has permanent residence. Such cases will be examined by the Missions / Posts on merits on case-to-case basis and, after issue of Business visa, an intimation will be sent to the Indian Mission /  Post in the applicant’s country of origin.
  • The documents/ papers pertaining to proposed business activity such as  the registration of the company under the Companies Act, proof of registration of the firm with the State Industries Department or the Export Promotion Council concerned or any recognised promotional body in the relevant field of industry or trade etc. will be thoroughly checked to decide the category of visa applicable to the foreigner
  • The grant of Business Visa is subject to any instructions issued by the Government of India on the basis of reciprocity with other foreign countries from time to time.



Who are eligible for a Business Visa ?

Ans.: A Business visa may be granted to a foreigner for the following purposes:-

(i) Foreign nationals who wish to visit India to establish industrial/business venture or to explore possibilities
to set up industrial/business venture in India.
(ii) Foreign nationals coming to India to purchase/sell industrial products or commercial products or consumer durables.
(iii) Foreign nationals coming  to India for technical meetings/discussions, attending Board meetings or general meetings for providing business services support.
(iv) Foreign nationals coming to India for recruitment of manpower.
(v) Foreign nationals who are  partners in the business and/or functioning as Directors of the company.
(vi) Foreign nationals coming to India for consultations regarding exhibitions or for participation in exhibitions, trade fairs, business fairs  etc.
(vii) Foreign buyers who come to transact business with suppliers/ potential suppliers at locations in India, to
evaluate or monitor quality, give specifications, place orders, negotiate further supplies etc., relating to goods or services procured from India.
(viii) Foreign experts/specialists on a visit of short duration in connection with an ongoing project with the objective of monitoring the progress of the work,conducting meetings with Indian customers and/or to provide technical guidance.
(ix) Foreign nationals coming to India for pre-sales or post-sales activity not amounting to actual execution of any contract or project.
(x) Foreign trainees of multinational companies/corporate houses coming for in-house training in the regional  hubs of the concerned company located in India.
(xi) Foreign students sponsored by AIESEC for internship on project based work in companies/industries.
(xii) Foreign nationals coming  as tour conductors and travel agents and / or  conducting business tours of foreigners or business relating to it, etc.

What is the duration of a Business Visa ?

Ans:   A Business Visa with multiple entry facility can be granted for a period up to five (5) years or for a shorter duration as per the requirement. A stay stipulation of a maximum period of six (6) months will be  prescribed for each visit by the concerned Indian Mission keeping in view the nature of the business activity for which such Business Visa is granted.  In case Missions/ Posts abroad, while issuing Business Visa, decide to prescribe a stay stipulation of maximum 6 months for each visit, a clear  endorsement should be made
stating "each stay not to exceed 6 months (or the duration of stay stipulation) and registration not required".   In case no such stay stipulation is being prescribed, a simple endorsement stating "registration within 14 days" should  be made.

Indian Missions can grant Business Visa with 10   years validity and multiple entry facility to the nationals of the United States of America. This visa should be issued with the stipulation that the stay in India during each visit shall not exceed six (6) months. In case business visa is granted for a period less than five years by the Indian Missions, the same can be extended up to a maximum period of five years subject to following:

(a) The gross sales/turnover from the business activities, for which the foreigner has been granted visa, is not
less than Rs.1 crore per annum (to be achieved within 2 years of setting up the  business).
(b) First extension on business visa shall be granted by the Ministry of Home Affairs.
(c) Further extensions, if required, may be granted by the State Governments/ UT administrations/ FRROs/
FROs on  year-to-year basis subject to good conduct, production of necessary  documents in support of
continued business activity  and no adverse  inputs, security related or otherwise, about the foreigner.
(d) The period of extension shall not be beyond five years from the date of issue of  the Business visa.
(e) If the extension of Visa is denied by MHA/FRRO/FRO/State Government/ UT Administration, the foreigner shall leave India forthwith on expiry of the period of validity of the visa.

What are the documents to be submitted alongwith application for a Business Visa?



Ans.     (i) The foreign national must have a valid travel document and a re-entry  permit, if required under the law of the country concerned.

Protected Area Permit(PAP)/Restricted Area Permit (RAP) regime

 Qn.1 :  Which are the areas covered by the Protected Area Permit (PAP)/Restricted Area Permit (RAP) regime ?
Answer:  Under the Foreigners (Protected Areas) Order, 1958, all areas falling between the ‘Inner line’, as defined in the said order, and the International Border of  the State have been declared as a
Protected Area. Currently, Protected Areas are located in the following States: -
(i) Whole of Arunachal Pradesh
(ii) Parts of Himachal Pradesh
(iii) Parts of Jammu & Kashmir
(iv) Whole of Manipur
(v) Whole of Mizoram
(vi) Whole of Nagaland
(vii) Parts of Rajasthan
(viii) Whole of Sikkim (partly in Protected Area and partly in Restricted Area)
(ix) Parts of Uttarakhand
However, as per the Circular dated 30.12.2010 issued by the Ministry of Home Affairs, the entire area of the States of Manipur, Mizoram and Nagaland has been excluded from the Protected Area regime
notified under the Foreigners (Protected Areas) Order 1958, initially for a period of one year w.e.f. 1.1.2011, subject to the following conditions:-
           (i) Citizens of  Afghanistan, China,  Pakistan and foreign nationals having their origin in these countries would continue to require prior approval of the Ministry of Home Affairs before their visit to the States of Manipur, Mizoram and Nagaland.
            (ii) Citizens of Myanmar visiting the States of Manipur, Mizoram and Nagaland beyond 16 Kms from the IndoMyanmar border would continue to require prior approval of the Ministry of Home Affairs for visiting these States.
          (iii)  All foreigners visiting these States will register themselves with the Foreigners Registration Officer (FRO) of the District they visit within 24 hours of their arrival. Under  the Foreigners (Restricted) Areas  Order,  1963, the following areas have been declared as  `Restricted’  Areas :-
(i) Andaman & Nicobar Islands -    Entire Union Territory
(ii) Sikkim -    Part of the State
Qn.2 : What are the guidelines for obtaining Protected Area Permit/ Restricted Area Permit?
Answer:  A foreign national is not normally allowed to visit a Protected / Restricted Area unless it is established to the satisfaction of the Government that there are extra-ordinary reasons to justify
such a visit. Every foreigner, except a citizen of Bhutan, who desires to enter and stay in a Protected or Restricted Area, is required to obtain a special permit from a competent authority delegated with
powers to issue such a special permit to a foreigner, on application.   In cases where the powers have not been delegated to any subordinate authority by the Government of India, the application for
special permit should be referred to the Ministry of Home Affairs for prior approval, at least eight weeks before the date of the expected visit.   With a view to promote tourism, some areas (notified by the
Government of India from time to time) can be visited by foreign tourists, either in groups, or as a couple in the case of a husband and wife, or by individuals, after obtaining the necessary permit from the
competent authority.  Necessary powers have been delegated to various authorities to issue the  special permit, without the prior approval of the Ministry of Home Affairs, to facilitate foreign tourists
subject to the following exceptions: 
(i) Special instructions applicable to foreign diplomats and members of the United Nations and International
Organisations holding Diplomatic / Official Passport are issued by the Ministry of External Affairs.
(ii) Citizens of Afghanistan, China and Pakistan and foreign nationals of Pakistani origin, shall not be issued a special permit without the prior approval of the Ministry of Home Affairs.
  Qn.3 :  What are the specific instructions to be followed by PAP/RAP holders?
Answer:
1. The permit is valid for group tourists consisting of two or more persons only.
2. The permit is valid for the specific tourist circuit/route and the specific entry / exit point.  No area other than
the ones indicated in the permit shall be visited.
3. The permit holder must keep sufficient number of photocopies of the permit as he/she may be required to
deposit a copy at each point of entry/exit.
4.The permit holder shall not stay in the restricted/protected area after the expiry of the permit.
 5. A foreigner must enter/exit the North-Eastern States by air only.
6. A foreigner can travel within the North Eastern states through the National Highways or by air. While travelling by road, the tour should be undertaken largely through the National Highways.  Where the places to be visited are situated on a National Highway, no other road should be utilised.  In cases where the places, which are to be visited, are not on a National Highway, the tour should be undertaken  in such a way that the
maximum distance is travelled on a National Highway, restricting the utilisation of other road routes to the
minimum.
Qn. 4 :  What are the specific instructions to be followed by Travel Agents, Tour operators and Owners of Guest Houses/hotels?
Answer :
1. Travel agencies/tour operators shall ensure that the tourist groups sponsored by them are in possession of
valid Restricted/Protected Area Permit.
2. It shall be the responsibility of the travel agents/tour operators to ensure that the tourist groups do not go to
places other than the ones that are permitted and also ensure that they do not stay there after the expiry of the
valid period.
3. Owners of the guest houses/hotels must ensure that only foreigners with valid  Restricted/Protected Area
Permits stay with them. It is mandatory for the guest houses/hotels and also the individuals, to inform the
local police about the arrival/departure of a foreigner within 24 hours if one foreigner stays with them.
Qn. 5 :  What is the procedure for grant of Protected Area/Restricted Area Permit:
Answer:
(1)  Foreign nationals coming as Group Tourists may submit an application for the grant of Protected/Restricted Area Permit to the Indian Mission in their country before coming to India.  The
Indian Mission may grant the Permit after due scrutiny, keeping in view the instructions issued by the Ministry of Home Affairs in this regard.  However, the Missions shall refer cases which are not covered by the powers delegated to them, for grant of Protected/ Restricted Area Permit, to the Ministry of Home Affairs for prior clearance.
(2) If foreign nationals, who are already in the country, desire to visit any area covered by the Protected /Restricted Area regime as group tourists, they should  submit the requisite application to any of the authorities to whom the powers to issue such a special permit have been delegated.  However, cases which are not covered by the powers delegated to the State Governments, or to the subordinate authorities, shall be referred to the Ministry of Home Affairs, with the recommendation of the State Government, for prior clearance. 
(3) In all cases received directly in the Ministry of Home Affairs for grant of Protected/Restricted  Area Permit, the requisite clearance would be conveyed by the Ministry of Home Affairs only after obtaining the recommendations of the State Government concerned.
(4) In all cases relating to grant of PAP/RAP for an individual foreign tourist, the proposal would require prior clearance from the Ministry of Home Affairs.  The requisite clearance would be conveyed by MHA only on the basis of the recommendation of the State Government concerned. 

INDIAN TOURIST VISA -FREQUENTLY ASKED QUESTIONS


As per the extant instructions of the Government of India, a Tourist
Visa can only be granted to a foreigner who does not have a residence or
occupation in India and whose sole objective of visiting India is recreation,
sight seeing, casual visit to meet friends and relatives etc. No other activity is
permissible on a Tourist Visa. The Tourist Visa is non-extendable and
non-convertible.
2. It has come to the notice of the Government that there has been
abuse/misuse of the Tourist Visa. With a view to curb the abuse/misuse of
the Tourist Visa, instructions have been issued by the Government imposing
the following restrictions:-
(a) In respect of foreign nationals holding Tourist Visas with multiple
entry facility, there should be a gap of at least 2 months between
two visits to the country on such a Tourist Visa.
(b) If any foreign national is required to visit the country again within
a period of 2 months of his last departure, such foreign national
should obtain special permission from the Mission/Post
concerned. The Mission/Post may consider such requests on
merits of each case.
3. Frequently asked questions with regard to the above issues and
replies thereto are outlined below for information, guidance and
compliance of all concerned:-
Q.1: Whether the gap of two months between two visits would apply to
all Tourist Visa holders ?
Ans. : The gap of two months between two visits would apply to all Tourist
Visa holders.
Q.2 : Whether the gap of two months between two visits would apply
irrespective of the duration of stay in India during the previous visit?
Ans.: The intention behind the stipulation of a gap of two months between
two visits on a Tourist Visa is to curb the abuse/misuse of the
Tourist Visa. With a view to ensure that the genuine tourists are not
affected by the recent guidelines, the following clarifications are
furnished:
(I) Foreigners holding Tourist Visas, who after initial entry into India
plan to visit another country largely on account of
neighbourhood tourism related travel and re-enter India before
finally exiting, may be permitted two or three entries, as the
case may be (need based), by the Indian Missions/Posts subject
to their submission of a detailed itinerary and supporting
documentation (ticket bookings). If they are already outside of
their country of origin, they can also get such an endorsement
from the nearest Indian Mission/Post.
(II) The Immigration authorities in all the Immigration Check Posts
may also allow such foreign nationals on Tourist Visas arriving in
India without the specific authorization from the Indian
Missions/Posts to make two or three entries into the country
(need based) subject to production of an itinerary and
supporting documentation (ticket bookings).
(III) The total period of stay in the country counted from the date of
first entry into the country shall not exceed the stay stipulation
period of 180 days or 90 days, as the case may be.
(IV) Once such a foreign national finally exits the country after
availing the facility of two or three entries (within the stay
stipulation period of 180 days or 90 days as the case may be),
there should be a gap of at least 2 months before he/she can
come again to the country.
(V) If any foreign national falling in the category as mentioned in
sub-para (IV) above is required to visit India again within a
period of 2 months after his/her last departure, such foreign
national should obtain special permission from the Mission/Post.
Such re-entry within the stipulated gap of two months may be
permitted only in emergent situations like death/serious illness in
the family, non-availability of connecting flights to return to
his/her country of origin or travel to another country or any
other exigent situation which can be duly justified with proper
documentation to the satisfaction of the Mission/ Post granting
the permission. The Mission/Post will have to examine each case
on merits before grant of requisite permission subject to the
following conditions:-
(a) The applicant should furnish an undertaking on the following
lines:-
(i) That the purpose of his/her visit is because of emergency
situation.
(ii) That he is not engaged in Business activities, nor in
Employment or pursuing studies/research etc.
(b) In all such cases i.e. those covered by sub-para V above, the
foreign national should register himself with the FRRO/FRO
concerned within 14 days of arrival. This registration may be
done with the FRRO/FRO concerned preferably at the first place
of entry. An endorsement to this effect will be made on the visa
sticker.
The requisite permission can be granted by the Mission/Post in any
country on merits of each case and subject to the conditions mentioned
above. However, intimation about the grant of permission must be
furnished by the Mission/Post granting such permission to the
Mission/Post from where the original Visa was issued.
VI. In emergent cases involving re-entry of persons of Indian origin on
Tourist Visa within the 2-month period of their earlier departure from
India, the FRROs/FROs may exercise their discretion in allowing such
passengers to enter the country after being convinced of the genuiness
of their visit.
VII. Mission/Post endorsing the requisite permission as explained in sub
paras (I) & (V) above may charge miscellaneous Consular Service fee
for making the requisite endorsement.
Q.3: Whether the permission for the second visit within the period of 2
months in respect of foreign nationals falling in the category mentioned in
sub para (V) in reply to Question (2) can be granted by the Posts?
Ans.: Yes.
Q.4: Whether the Mission/Post in any country can grant permission for the
second visit within the period of 2 months in respect of foreign
nationals falling in the category mentioned in sub para (V) in reply to
Question (2) or whether this can be granted only by the Mission/Post
in the country of origin of the applicant.
Ans.: The requisite permission can be granted by the Mission/Post in any
country on merits of each case and subject to the conditions
mentioned in sub-para (V) in reply to Question (2) above. Intimation
about the grant of permission may be furnished to the Ministry of
Home Affairs (Foreigners Division) and to the Mission/Post from
where the original Visa was issued.
Q.5: Are there any standard guidelines for the Indian Missions/Posts to
decide the requests for re-entry within the stipulated gap of two
months?
Ans.: The re-entry within the stipulated gap of two months, as mentioned
in sub para (V) in reply to Question (2), may be permitted only in
emergent situations like death/serious illness in the family, nonavailability
of connecting flights to return to his/her country of origin
or travel to another country or any other exigent situation which can
be duly justified with proper documentation to the satisfaction of the
Mission/Post granting the permission. The Mission/Post will have to
examine each case on merits before grant of requisite permission.
Q.6: In cases mentioned in sub para (V) in reply to Question 2, where will
the foreigner register himself?
Ans.: The registration should be done with the FRRO/FRO concerned
preferably at the first place of visit on re-entry.
Q.7: If a tourist’s passport is not stamped to indicate no re-entry within
two months, can the tourist assume that he will be allowed to reenter
India within two months?
Ans.: No. Even if the tourist’s passport is not stamped, the restrictions as
laid down will be applicable.
Q.8 Whether the restriction of two months gap for re-entering India is
applicable to PIO/OCI card holders and foreigners holding business,
employment, student and other categories of visa?
Ans.: No. The two months gap is applicable only to Tourist Visa
holders.
Q.9: Whether any fee is required to be charged for making the requisite
endorsement on the Passport.
Ans.: Miscellaneous Consular Service fee may be charged for making an
endorsement.
Q.10 : How will medical tourists who return regularly to India for onward
treatment be handled?
Ans.: For persons coming for medical treatment, there is a separate
category of Medical Visa. Foreign nationals coming for medical
treatment will have to come only on Medical Visa and not on Tourist
Visa.
Q.11: How will the family members of diplomatic households who do not
qualify for diplomatic visas (e.g. older children or domestic partners)
be handled?
Ans.: The family members of diplomatic households who do not qualify for
diplomatic visas may have to come on an ‘Entry(X)’ Visa if eligible. If
they come on Tourist Visa, the restrictions as laid down will be
applicable.
